Everyday AppsTerms of Service
These Terms of Service ("Terms") govern your use of everyday-m.com and the apps published by H. Tech Innovation LLC, doing business as Everyday Apps. By using our services you agree to these Terms. If you do not agree, please do not use them.
1. The services
We provide mobile and web apps and a website (the "services"). Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use our apps for your own personal, non-commercial purposes. Some features may change, and we may add or remove features over time.
2. Accounts
You must be at least 13 years old, and old enough to form a binding contract where you live, to use our services. Provide accurate information, keep your login details secure, and tell us promptly if you think your account has been accessed without permission. You are responsible for activity under your account.
3. Purchases and subscriptions
Paid features and subscriptions purchased on our website are billed through Stripe, our payment processor. By making a purchase you also agree to Stripe's terms as they apply to payment processing. Purchases made inside an app store are billed by that store under its own terms.
Prices and billing cycles (for example monthly or yearly) are shown before you buy. Subscriptions renew automatically at the end of each billing period for the same period and at the then-current price, until you cancel. We will tell you in advance of any price change. By subscribing, you authorize us (or the store) to charge your payment method on each renewal.
Cancellation. You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. For website subscriptions, cancel in your account or by emailing support@everyday-m.com. For App Store or Google Play subscriptions, cancel in your Apple or Google account settings. Deleting an app does not cancel a subscription.
4. Refunds
Refunds are handled as described in our Refund Policy.
5. Acceptable use
You agree not to:
- use the services for anything unlawful, fraudulent, or harmful;
- copy, modify, reverse engineer, decompile, or attempt to extract the source code of our apps, except where the law allows;
- resell, sublicense, rent, or share your account or paid access with others;
- interfere with or disrupt the services, or attempt to gain unauthorized access to them or to other users' accounts;
- use bots, scrapers, or automated means to access the services without our permission;
- upload malware or content that infringes the rights of others; or
- circumvent any usage limits or security features.
We may suspend or end access if you break these rules.
6. Intellectual property
The apps, website, and all related content, software, design, and trademarks, including the Everyday Apps name and logo, are owned by H. Tech Innovation LLC or its licensors and are protected by law. These Terms give you a license to use them, not ownership. You keep ownership of the content you submit, and you give us a limited license to host and process it only to provide the services to you. If you send us feedback, we may use it without obligation to you.
7. Disclaimers and limitation of liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, H. TECH INNOVATION LLC AND ITS MEMBERS, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.
Some places do not allow certain limits, so parts of this section may not apply to you.
8. Termination
You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we stop offering a service. After termination, your license ends and sections that by their nature should survive (including ownership, disclaimers, limits of liability, and governing law) will continue to apply.
9. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas, and you and we consent to those courts' jurisdiction, unless the law where you live gives you the right to bring a claim elsewhere.
10. Changes to these Terms
We may update these Terms from time to time. We will post the new version here with a new "Last updated" date, and for material changes we will notify you by email or in the app before they take effect. If you keep using the services after the change, you accept the updated Terms.
